1)
Mare shall be of healthy and sound breeding condition.
A veterinarian health certificate and uterine culture are highly
recommended. If the mare fails to
settle in foal after two cycles, breeder may require the Mare Owner to obtain a
current reproductive exam/uterine culture prior to any further shipments.
2) This contract contains a “live-foal guarantee.”
A live foal is defined as a
new born foal
that stands and nurses without assistance. If the Mare Owner does not receive a life foal (as the result
of the death or absence of the foal), Mare Owner will receive a return breeding
privilege for the following breeding season, but only if Breeder is notified
within 30 days of loss and receives a licensed veterinarian’s statement
confirming death. If, after being
pronounced safe in foal, the mare should miscarry, abort or prove barren, Mare
Owner has the privilege to return mare for breeding and/or request additional
semen shipments during the current breeding season, Feb 1 through Aug 31, or the
following breeding season.
3)
Breeder’s Certificate will
be issued for the foal conceived by this mating only after the stallion fee and
all other expenses have been paid in full and the mare is pronounced safe in
foal after 45 days. The
Breeder will forward the Certificate after February, of next year.
It is important that the mare be reconfirmed in foal at the end of the
breeding season. Please be
reassured that you will receive your Certificate prior to the time your mare is
due to foal.

If the mare fails to
settle for any reason, the Mare Owner will hold the Breeder blameless

It is further agreed that
should the stallion die or be declared infertile by a veterinarian before the
mare settles (with maximum time limit of August 31) any fees paid, less
expenses, will be refunded to Mare Owner, thereby canceling the breeding
contract

All booking fees are
non-refundable. If
a mare fails to settle in six cycles, an additional $100 booking fee will be
required. Should the mare die or
prove infertile, Breeder will accept another mare according to the terms and
conditions of this contract, however more than one transfer of the mare booked
may require an additional booking fee.

This contract is
non-transferable without prior written approval from the Breeder

The $400 breeding fee
includes a non-refundable booking fee of $100, due upon execution of this
contract. The
balance of $ 300, as well as any unpaid breeding expenses, is due before mare
leaves premises. Any
balance due that has not been paid within sixty days may be subject to a service
charge of either $10 or 12% interest each month; whichever is greater, on the
unpaid balance. If the afore mentioned fees are not paid, Enchanted
Equestrians reserves the right to assert a breeder’s lien. All costs incurred
collecting delinquent charges she be the responsibility of the mare owner.
These costs include but not limited to the following: court costs,
attorney fees, skip tracing. All expenses must be paid before or when mare is
picked up.
9)
Mare Care runs per day
$6.00 (wet) and $8.00 a day (dry)
10) Mares
that are not halter broken will not be accepted.
11) Mares
owner understands and agrees that Enchanted Equestrian facility, manger, owner,
handler, will not be responsible for any accident, death, or sickness to the
above mare or to any foal. It is also understood that the mare’s owner/handle
will not be responsible for any disease, accident, or injury to the stallion.
When
the Mare Owner and the Breeder sign this contract, it will then be binding on
both parties, subject to the above terms and conditions:
